These Terms of Service ("Terms") govern your access to and use of www.teair.com.au (the "Site") and the purchase of products sold by Meditech SA Pty Ltd (ABN 19 623 079 407), trading as TE Air Store ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to purchase from this Site. If you are purchasing on behalf of a business, hospital, clinic, or other organisation, you confirm you have authority to bind that entity to these Terms.

3. Products and Product Information

3.1 We make reasonable efforts to display accurate descriptions, specifications, and images of our products, including the TE Air portable ultrasound device. Actual products may vary slightly from images shown.

3.2 Medical device disclaimer. Our portable ultrasound products are [medical devices regulated by the Therapeutic Goods Administration (TGA) / registered on the Australian Register of Therapeutic Goods (ARTG) under entry number 326044. This device is intended for use by qualified healthcare professionals and must be used strictly in accordance with the instructions for use provided. Nothing on this Site constitutes medical advice, and the product is not a substitute for professional medical diagnosis or treatment.

3.3 We do not make any representation that the product is suitable for diagnosing, curing, or preventing any specific disease or condition beyond what is stated in its TGA-approved intended purpose and instructions for use.

4. Orders and Acceptance

4.1 Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including where a product is out of stock, mispriced, or where fraud is suspected.

4.2 A contract for sale is formed only when we send you confirmation that your order has been dispatched.

4.3 Prices are listed in Australian Dollars (AUD) and, unless stated otherwise, include GST where applicable.

5. Payment

5.1 Full payment is required at the time of order unless otherwise agreed in writing (e.g. approved trade/business account terms).

5.2 We use third-party payment processors. By providing payment details, you warrant that you are authorised to use the payment method provided.

6. Shipping and Delivery

6.1 We currently ship to addresses within Australia only. Orders are dispatched  within 5–7 business days of payment confirmation, with standard shipping provided free of charge.

6.2 Estimated delivery timeframes are provided in good faith and are not guaranteed. Risk in the goods passes to you on delivery. Full details, including estimated delivery windows by region and what to do about missing, delayed, or damaged deliveries, are set out in our Shipping Policy, which forms part of these Terms.


7. Returns, Refunds, and Consumer Guarantees

7.1 For change-of-mind returns, eligible products may be returned within 14 calendar days of delivery, provided the item is unopened, unused, unactivated, and in its original packaging with proof of purchase. Return shipping costs are the customer's responsibility, and approved refunds are processed within 5–7 business days to the original payment method (original shipping charges and payment processing fees are non-refundable). Full eligibility conditions and the return process are set out in our Refund Policy, which forms part of these Terms.

7.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded.

7.3 Under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

7.4 For medical devices, any product faults should be reported immediately as this may also be relevant for mandatory incident reporting to the TGA.

8. Warranty

8.1 This product is covered by a 3-year manufacturer's warranty on the probe and 1-year manufacturer's warranty on the Air Capsule against defects in materials and workmanship, in addition to your rights under the Australian Consumer Law.

8.2 The warranty does not cover damage caused by misuse, unauthorised repair, normal wear and tear, or failure to follow the instructions for use.

9. Intellectual Property

All content on this Site, including text, images, logos, and product documentation, is owned by or licensed to us and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, and subject to Section 7 (Consumer Guarantees), our liability for any claim arising out of or in connection with these Terms or your use of the Site or products is limited, at our option, to: (a) the replacement or repair of the goods; or (b) the resupply of the services; or (c) the cost of replacing or repairing the goods or resupplying the services.

10.2 To the extent permitted by law, we exclude all liability for indirect, special, or consequential loss arising from use of the Site or products.

10.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, or liability that cannot be excluded under the Australian Consumer Law.

11. Privacy

Our collection and handling of your personal information is governed by our Privacy Policy, which is prepared in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

12. Prohibited Conduct

You must not use the Site to: (a) engage in unlawful, fraudulent, or misleading conduct; (b) infringe our intellectual property or that of any third party; (c) attempt to gain unauthorised access to our systems.

13. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any linked third-party site.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia and the Commonwealth of Australia.

16. Complaints and Dispute Resolution

If you have a complaint, please contact us at info@teair.com.au or 1800 940 425 in the first instance (Monday to Friday, 9:00 am – 5:00 pm ACST). If we cannot resolve your complaint, you may contact:

  • Australian Competition and Consumer Commission (ACCC) — for consumer law matters
  • Therapeutic Goods Administration (TGA) — for medical device incident reporting, at www.tga.gov.au
  • Your relevant state or territory fair trading/consumer affairs body
